The Department of Justice lost their case against New Hampshire. A case which centered around their misguided decision to enforce their “opinion” on the Federal Wire Act. An opinion which one judge has already said is not correct. But apparently, that doesn’t mean they don’t have plans for Wire Act enforcement.
One would think that the highest law enforcement agency in the country would respect the decision of a federal judge, but that doesn’t seem to be the route the DoJ is taking. Instead, they have only delayed the enforcement of their opinion until January 1st, 2020.
In a memo from the Deputy Attorney General, the Justice Department says there will be no enforce action on the revised interpretation of the Wire Act until after December 31, 2019, or 60 days after the final judgement in the New Hampshire case.
Whether or not they are serious about enforcement – or perhaps posturing until they see what happens next – is anyone’s guess. You can read more on the Justice Department and the potential of Wire Act enforcement at iGaming Business.
