The time is approaching for the DOJ Wire Act appeal to get started. Briefs are due by November 12, and we may soon get a look at how the case will proceed.
After the deadline on the 12th, appellees will have 30 days to file a brief in response. If all parties adhere to deadlines and take no exceptions for holidays, this puts the final brief in the hands of the Appeals Court by January 2. With a consideration for the holiday season, all briefs should still be submitted before the end of January.
The case over the Federal Wire Act (a law enacted in 1961 to stop organized crime from bookmaking) which the DOJ now believes applies to forms of online gambling. However, on June 3, 2019 the US District Court in New Hampshire set aside that interpretation of the Wire Act, ruling it only applies to sports betting.
